§ 1 General Provisions

  • These Terms of Service set out the rules for the use of the website available at: sfera0.ai and the contact form made available through it.
  • The owner and operator of the website is the company under the business name: Sfera0 sp. z o.o. with its registered office in Poznań, address: ul. Milczańska 22/9, 61-131 Poznań, entered in the register of entrepreneurs of the National Court Register (Krajowy Rejestr Sądowy) by the District Court Poznań – Nowe Miasto i Wilda in Poznań under KRS number: 0001220454, NIP (Tax Identification Number): 7822964957, REGON: 543843620.
  • The website is informational in nature and serves in particular to present the Sfera0 Products, i.e. Sfera0 Voice — an AI-based tool for analysing coaching communication, and Sfera0 Hub — a Decision Intelligence platform for sports clubs.
  • Use of the website, use of the AI Assistant and submission of the contact form does not lead to the conclusion of an agreement for the use of the Products, does not constitute placing an order, and does not give rise to any payment obligation on the part of the user.
  • The terms of use of the Products, including the rules for system access, payments, processing of recordings, transcripts and reports, are set out in separate Sfera0 Voice and Sfera0 Hub service agreements and order forms, which will be provided to the user before concluding an agreement for the use of a given Product.

§ 2 Definitions

  • Sfera0 / we — Sfera0 sp. z o.o. with its registered office in Poznań, address: ul. Milczańska 22/9, 61-131 Poznań, with share capital of PLN 6,000.00, entered in the register of entrepreneurs of the National Court Register (Krajowy Rejestr Sądowy) by the District Court Poznań – Nowe Miasto i Wilda in Poznań under KRS number: 0001220454, NIP (Tax Identification Number): 7822964957, REGON: 543843620.
  • Sfera0 Voice — a SaaS tool for analysing coaching communication based on AI and Self-Determination Theory.
  • Sfera0 Hub — a Decision Intelligence SaaS tool supporting sports clubs in making decisions on player development.
  • Products — Sfera0 Voice and Sfera0 Hub jointly.
  • SDT / Self-Determination Theory — the theory of motivation developed by Edward L. Deci and Richard M. Ryan, to which the Sfera0 Voice methodology refers.
  • Website/Service — the website available at sfera0.ai, including the subpages dedicated to the individual Products, serving to present them and enabling contact with Sfera0.
  • Contact Form — the form available on the Website, enabling in particular the submission to Sfera0 of an inquiry, a request for contact, a request for an offer or arranging a meeting.
  • AI Assistant — the AI-based voice assistant made available on the Website, allowing the User to hold a voice conversation in order to obtain information about Sfera0, the Website or the Products. The User is informed that they are interacting with an artificial intelligence system before the conversation begins.
  • User — a natural person using the Website, and in particular the Contact Form.
  • Terms of Service — this document.

§ 3 Type and scope of services provided by electronic means

  • Through the Website, Sfera0 provides the following services by electronic means:
    • enabling familiarisation with information about the Products;
    • enabling the submission of an inquiry to Sfera0 via the Contact Form;
    • enabling the request for contact from Sfera0;
    • enabling the granting of consent to receive additional commercial or marketing information;
    • making available the AI Assistant enabling a voice conversation with Sfera0.
  • The contact form serves exclusively to establish contact with Sfera0, submit an inquiry or obtain information about the Products.
  • The submission of the Contact Form does not constitute the conclusion of an agreement for the use of the Products nor the acceptance of any offer by Sfera0 or by the User. Information posted on the Website is of an informational and marketing nature and does not constitute an offer within the meaning of the Polish Civil Code (Kodeks cywilny) of 23 April 1964, unless expressly stated otherwise.
  • After receiving the Contact Form, Sfera0 may contact the User in order to provide a response, present additional information, arrange a meeting or prepare an individual offer.
  • An agreement for the use of the Products may be concluded only after the User has been presented with the relevant terms of use of the given Product, in particular the Sfera0 Voice or Sfera0 Hub terms of service, commercial terms or the order form.
  • Use of the AI Assistant is voluntary and requires the User's prior consent. Conversations with the AI Assistant are recorded and transcribed, and their content is processed in order to provide a response. A User who does not wish to be recorded may use the Contact Form or email. The AI Assistant provides information of a general nature; its statements do not constitute an offer or a binding assurance on the part of Sfera0.

§ 4 Technical requirements for using the Website

  • The following are required to use the Website:
    • a device with Internet access;
    • a current version of a web browser supporting cookies, JavaScript and HTML5 technologies;
    • an active email account — in the case of using the Contact Form;
    • a device equipped with a microphone and consent for the browser to access the microphone — in the case of using the AI Assistant.
  • Use of the Website may require enabling cookies or similar technologies to the extent necessary for the proper functioning of the Website.
  • Detailed information regarding cookies and similar technologies is available in the Privacy Policy.

§ 5 Rules for using the Website and the Contact Form

  • The User is obliged to use the Website in accordance with the law, these Terms of Service and good practice.
  • The User is obliged to provide true, current and non-misleading data in the Contact Form.
  • It is prohibited to provide, through the Website or the Contact Form, content of an unlawful nature, in particular content:
    • infringing personal rights or the rights of third parties;
    • infringing intellectual property rights;
    • containing personal data of third parties without a legal basis;
    • containing offensive, defamatory, vulgar or unlawful content;
    • containing malicious software, links to harmful content or other elements that may disrupt the operation of the Website.
  • The User may not take actions aimed at disrupting the operation of the Website, circumventing security measures, gaining unauthorised access to Sfera0's systems, or mass submission of inquiries through the Contact Form.
  • Sfera0 may block or disregard an inquiry submitted through the Contact Form if it violates these Terms of Service, constitutes spam, contains unlawful content, or makes it impossible to provide a response.

§ 6 Information on specific risks

  • In fulfilment of the obligation arising from the Polish Act on Providing Services by Electronic Means (ustawa o świadczeniu usług drogą elektroniczną), Sfera0 informs that the use of the Website may involve typical risks associated with the use of the Internet, in particular the risk of:
    • malicious software;
    • phishing;
    • interception of data transmissions when using unsecured network connections;
    • unauthorised access to the User's device or email;
    • providing data in a form impersonating the Website.
  • The User should apply basic security measures, in particular use current software, a secured Internet connection, and exercise caution when opening links or messages received electronically.

§ 7 Information on the function and purpose of software or data

  • In connection with the use of the Website, Sfera0 may introduce into the User's ICT system data or software that is not a component of the service content, in particular cookies, session data, local storage, session storage, pixels, tags or similar technologies.
  • The data and technologies referred to above may be used in particular for the purpose of:
    • ensuring the proper functioning of the Website;
    • handling the Contact Form;
    • ensuring the security of the Website;
    • remembering the User's preferences;
    • analysing traffic on the Website;
    • conducting marketing activities — only to the extent requiring the User's consent and after such consent has been given;
    • operating the AI Assistant, including transferring the recording and transcript of the conversation to the service provider operating the AI Assistant — only after the User has given consent.

§ 8 Liability

  • Sfera0 exercises due care to ensure that information presented on the Website is current and reliable; however, such information is of a general, informational and marketing nature.
  • Sfera0 is not liable for interruptions in the availability of the Website or the Contact Form arising from causes beyond Sfera0's control, in particular Internet network failures, actions of hosting service providers, maintenance work, force majeure, or malfunctioning of the User's device, software or Internet connection.
  • Sfera0 is not liable for the consequences of the User providing in the Contact Form untrue, outdated or incorrect data, in particular an email address or telephone number that prevents a reply.
  • Responses generated by the AI Assistant are informational in nature and may contain inaccuracies. Sfera0 is not liable for decisions taken by the User solely on the basis of content obtained from the AI Assistant. Only information confirmed by Sfera0 in written or documentary form is binding.

§ 9 Intellectual property rights

  • The content, materials, designations, graphic elements, trademarks, names, layout of the Website and other elements made available on the Website may be subject to intellectual property rights of Sfera0 or third parties.
  • Use of the Website does not mean granting the User a licence or transferring any rights to elements of the Website or the Products, beyond the right to use the Website to the extent resulting from its normal intended purpose.
  • It is prohibited to copy, distribute, modify or use the content available on the Website for commercial purposes without the prior consent of Sfera0, unless otherwise provided by law.

§ 10 Personal data

The rules for processing Users' personal data, including data provided through the Contact Form, are set out in the Privacy Policy available on the Website.

§ 11 Complaints

  • The User may submit a complaint regarding the operation of the Website, and in particular the Contact Form.
  • A complaint may be submitted electronically to the email address complaints@sfera0.ai. The complaint should contain at least the User's first and last name, business name or name, a description of the issues raised, and an indication of the proposed manner of resolving the complaint.
  • Sfera0 will consider the complaint within 14 days of its receipt. If the complaint does not contain the information necessary for its consideration, Sfera0 will, within 14 days of its receipt, request the User submitting the complaint to supplement it to the necessary extent, and the 14-day period will then run from the day of delivery of the supplemented complaint.
  • A response to the complaint is sent exclusively to the email address from which the complaint was sent.

§ 12 Amendments to the Terms of Service

  • Sfera0 may amend the Terms of Service in particular in the event of:
    • changes in the law;
    • changes in the functionality of the Website;
    • changes in Sfera0's data;
    • changes in the operation of the Contact Form;
    • the need to clarify the rules for using the Website.
  • Sfera0 may amend the Terms of Service at any time. Sfera0 will notify of the amendment by publishing the new version of the Terms of Service on the Website. The amendment to the Terms of Service enters into force 14 days after the day of publication of the new version of the Terms of Service on the Website, unless a later effective date results from the content of the notice of amendment.

§ 13 Final provisions

  • These Terms of Service are governed by Polish law.
  • In the event of any discrepancy between the Polish and English versions of these Terms of Service, the Polish version prevails.
  • These Terms of Service are effective from 30 July 2026.
  • The User may contact Sfera0 in particular:
    • in writing to the address: ul. Milczańska 22/9, 61-131 Poznań,
    • electronically, through the Contact Form.
